1. Acceptance of Terms

By connecting to and using the Pendio Guest Wi-Fi Service (“Service”), you acknowledge that you have read, understood, and agreed to comply with these Terms of Service (“TOS”). If you do not agree to these terms, you must immediately discontinue use of the Service.

Pendio, a software service operated by NFY Interactive, Inc., provides this network access as a courtesy to guests of participating businesses. We reserve the right to modify, suspend, restrict, or terminate your access at any time, for any reason, without notice. Your continued use of the Service constitutes your acceptance of any modified terms.

2. Age Restriction

By using this Service, you affirm that you are at least 13 years old. If you are under 18, you may only use this Service with the consent and supervision of a parent or legal guardian. If you do not meet these age requirements, you are prohibited from using the Service.

3. Privacy & Security Disclaimer

You acknowledge that Wi-Fi is an inherently insecure communication medium, and by using this Service, you assume all associated risks, including but not limited to:

  • Interception of your data transmissions.
  • Unauthorized access to your device(s).
  • Exposure to viruses, malware, or phishing attempts.

Pendio and its affiliated businesses do not guarantee the privacy or security of your data while using the Service. Users are solely responsible for maintaining the security of their own devices, accounts, and online activities.

While Pendio may attempt to restrict access to explicit or malicious content, we do not guarantee that such content will be fully blocked. You are responsible for ensuring that your internet usage complies with all applicable laws and regulations.

4. Acceptable Use Policy (AUP)

By using the Service, you agree to use it responsibly and legally. Prohibited activities include, but are not limited to:

4.1 Illegal Activities

  • Engaging in any unlawful activity, including fraud, hacking, cybercrime, identity theft, or violating intellectual property rights.
  • Transmitting or distributing child exploitation material, pornography involving minors, or other obscene content.
  • Spamming, sending unsolicited emails, or using the Service for phishing or fraudulent schemes.
  • Attempting to access unauthorized networks, systems, accounts, or devices.

4.2 Security Violations

  • Engaging in hacking, port scanning, denial-of-service attacks (DDoS), or spreading malware, viruses, or Trojan horses.
  • Attempting to circumvent any security measures implemented by Pendio or our partner businesses.

4.3 Bandwidth & Network Abuse

  • Excessive bandwidth usage that disrupts or negatively impacts the network experience for others.
  • Using peer-to-peer (P2P) services, torrents, or large file-sharing programs.
  • Any activity that degrades, disrupts, or interferes with the Service or any connected systems.

4.4 Inappropriate Content & Behavior

  • Accessing, transmitting, or distributing content that is obscene, defamatory, offensive, threatening, harassing, or violent.
  • Engaging in cyberbullying, harassment, or hate speech.
  • Sharing, downloading, or promoting illegal gambling, Ponzi schemes, or pyramid schemes.

4.5 Commercial & Unauthorized Use

  • Using the Service for any form of resale, redistribution, or unauthorized business activity.
  • Hosting web services, email servers, or other business operations using the guest Wi-Fi.

5. Enforcement & Termination of Service

Pendio reserves the right to:

  • Monitor network activity (to the extent permitted by law) for security and compliance.
  • Block, suspend, or permanently ban devices or users found violating these terms.
  • Report violations to law enforcement authorities and cooperate with investigations.

Pendio has no obligation to provide notice before terminating access to any user violating this TOS.

6. Liability Disclaimer

YOU ACKNOWLEDGE AND AGREE THAT THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO:

  • No guarantee of availability, speed, or performance.
  • No warranty of security or privacy.
  • No liability for damages, data loss, or financial harm resulting from use of the Service.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PENDIO, NFY INTERACTIVE, INC., AND OUR PARTNER BUSINESSES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

7. Indemnification

By using the Service, you agree to indemnify, defend, and hold harmless Pendio, NFY Interactive, Inc., our partner businesses, and affiliated entities from any claims, damages, liabilities, or legal fees resulting from your use or misuse of the Service.

8. Compliance with Government & Law Enforcement Requests

Pendio may be required to:

  • Monitor, log, or disclose user activity to comply with laws, regulations, subpoenas, or legal requests.
  • Cooperate with authorities in the investigation of cybercrimes, threats, or illegal activities.

9. Changes to These Terms

Pendio reserves the right to modify or update these Terms of Service at any time, without notice. Your continued use of the Service after any changes indicates your acceptance of the revised terms.

10. Governing Law
